Terms of Service

1. Acceptance of Terms
By creating an account or using Outstanding ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
2. Description of Service
Outstanding is an AI-powered job application service that helps users generate tailored CVs and cover letters. The Service uses artificial intelligence (currently Google Gemini and OpenAI) to analyse your professional profile and target job descriptions, then generates optimised application documents. All documents generated by the Service are produced by artificial intelligence.
3. Account Responsibilities
- You must provide accurate information when creating your account.
- You are responsible for maintaining the security of your account credentials.
- You must be at least 16 years old to use the Service.
- You may only create one account per person. Creating multiple accounts to abuse credit systems is prohibited.
4. Your Content and Data
You retain ownership of all personal data and content you provide to Outstanding, including your professional profile, uploaded CVs, and any text you enter.
By using the Service, you grant us a limited licence to process your data as necessary to provide the Service, including sending your professional profile and job descriptions to our AI providers for document generation and quality evaluation.
5. AI-Generated Content
CVs, cover letters, and other documents generated by our AI are created based on the information you provide. You are granted full rights to use, modify, and distribute any AI-generated content created through your account.
You acknowledge that:
- AI-generated content may contain errors or inaccuracies. You are responsible for reviewing and verifying all generated documents before submitting them to employers.
- Quality scores and feedback provided by the AI are advisory and do not guarantee any particular outcome in your job applications.
- We do not guarantee that AI-generated documents will pass any specific Applicant Tracking System (ATS) or lead to interviews or job offers.
- You must not present AI-generated content as human-written where such representation would be misleading or where disclosure of AI involvement is required by applicable law, including the EU Artificial Intelligence Act.
6. Intellectual Property
The Service, including its design, features, code, AI pipelines, and branding, is owned by Outstanding and protected by intellectual property laws. Nothing in these Terms grants you any rights to our intellectual property except the limited right to use the Service as described in these Terms.
As stated in Section 5, you own and may freely use all AI-generated content created through your account.
7. Credits and Payments
- The Service operates on a credit-based system. Each application generation consumes credits.
- Credit balances are non-transferable and non-refundable except where required by law.
- If you purchase credits, you have a 14-day right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, unless you have already used the credits, in which case you acknowledge that you lose your right of cancellation to the extent credits have been consumed.
- We reserve the right to modify pricing and credit costs with reasonable notice.
8. Acceptable Use
You agree not to:
- Use the Service to generate fraudulent, misleading, or deceptive application materials.
- Attempt to reverse-engineer, scrape, or extract the AI models or proprietary algorithms used by the Service.
- Use automated scripts, bots, or other means to access the Service in a way that exceeds normal human usage.
- Interfere with or disrupt the Service or its infrastructure.
- Use the Service for any unlawful purpose.
9. Service Availability
We aim to provide a reliable service but do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control, including third-party AI provider outages.
10. Force Majeure
We are not liable for any failure or delay in providing the Service caused by events beyond our reasonable control, including but not limited to third-party service outages, natural disasters, government actions, pandemics, or internet disruptions.
11. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" without warranties of any kind, whether express or implied.
- We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
- Our total liability for any claims arising from these Terms or the Service is limited to the amount you paid us in the 12 months preceding the claim.
- We are not responsible for employment decisions made by third parties based on documents generated through the Service.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
12. Indemnification
You agree to indemnify and hold harmless Outstanding from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your use of the Service in violation of these Terms, (b) any content you provide that is false, misleading, or infringes third-party rights, or (c) any claims by third parties relating to documents you submit that contain inaccurate or fabricated information.
13. Account Termination
- You may delete your account at any time through the Account Settings page. Deletion is immediate and permanent.
- We may suspend or terminate your account if you violate these Terms, with reasonable notice where possible.
- Upon termination, all your data will be permanently deleted in accordance with our Privacy Policy.
14. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or through the application and ask you to review and accept the updated Terms before continuing to use the Service. Your continued use of the Service after accepting updated Terms constitutes agreement to those changes.
15. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of England and Wales.
We encourage you to contact us first at support@outstanding.cv to resolve any dispute informally. If we cannot resolve your complaint, you may refer it to a certified alternative dispute resolution (ADR) provider. You also retain the right to bring proceedings in the courts of England and Wales.
16. General Provisions
- Entire agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Outstanding regarding the Service.
- Severability: If any provision of these Terms is found to be unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.
- No waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
- Assignment: We may assign our rights and obligations under these Terms to another organisation, for example in connection with a merger or acquisition. You may not assign your rights under these Terms without our prior written consent.
